Affirmative action in hiring is when race, ethnicity, disabilities, military background, socioeconomic status, and/or gender are considered when making hiring decision as a means to provide equal employment opportunity and fairness in the workplace.

Affirmative action is often erroneously described as a quota system. Companies are expected to track applicants and focus on nondiscrimination based on race and gender, as opposed to simply increasing the number of minorities and females hired.

They are still expected and required to always hire the most qualified candidate for the position. Failure to do so would violate other employment-based discrimination laws. 

Equal Employment Opportunity

Federal contractors and subcontractors must take affirmative action to recruit qualified minorities, women, people with disabilities, and veterans. Affirmative action in the workforce is also known as Equal Employment Opportunity, and the companies that create these programs call themselves “Equal Opportunity Employers.” 

Although the two are colloquially interchangeable, Equal Employment Opportunity focuses on discrimination against any person’s race, gender, orientation, or ability. Affirmation action is a response to the old days of discrimination against minorities including African-Americans, Hispanics, Asians, Native Americans, and Europeans.

What Constitutes Affirmative Action

Affirmative actions (which include outreach, training programs, and other efforts) help to prevent discrimination in employment practices and to promote equal employment opportunity.

Many employers have written affirmative action programs that they update annually. Companies with over 50 employees and provide over $50,000 in goods and services to the government are required to create an affirmative action program.
